Stop and search in Chile and its conformity with international human rights law

Abstract

This article examines the regulation of stop and search proceedings in Chile, as contained in Article 85 of the Criminal Procedure Code and in Article 12 of Law 20.931, both in its current formulation and in the proposal for legal reform presented in 2019 by President Sebastián Piñera, in order to analyse their conformity with the international obligations binding on Chile and included in several human rights treaties. The article explains that the current regulation and the proposal for extension of police powers amount to a violation of the guarantees of personal liberty and freedom of movement, privacy and non-discrimination, as well as the specific guarantees that protect the rights of children and adolescents.
